Terms and Conditions

Article 1 — Seller and scope

These terms and conditions apply to all orders placed through the online designer on personalisedcondoms.com. The seller and your contractual partner is:

Article 2 — Subject of the contract

We produce individually printed condom wrappers according to the design you create in the online designer. Only the wrapper is printed; the condom itself is an unaltered branded product with CE marking, tested to EN ISO 4074. Production and dispatch take place at our workshop in the United Kingdom (Kissy Bang Bang).

Article 3 — Formation of the contract

The presentation of products in the online designer is not a legally binding offer but an invitation to place an order. By completing payment through our payment provider Stripe, you make a binding offer to purchase the product you designed. The contract is formed when we confirm your order by email, at the latest when the goods are dispatched. After payment is received, you get an order number and a payment confirmation.

We store the text of the contract. We also send you the details of your order by email. The language of the contract is English.

Article 4 — Prices and shipping costs

The prices per design shown in the online designer at the time of ordering apply. The unit price depends on the quantity ordered (tiered pricing).

We deliver as an export from the United Kingdom. The prices shown are exclusive of any European Union VAT. On import into the European Union, import VAT and, where applicable, customs duties may apply; these are payable by the recipient and are not included in the price.

Shipping costs are a flat 9.90 € per order, regardless of quantity. No setup or prepress fees are charged.

Article 5 — Payment

Payment is made in euros through our payment provider Stripe (card, Apple Pay, Google Pay and other methods offered by Stripe). The full amount is due when you order. Production starts once payment is received.

Article 6 — Your design, third-party rights and permitted content

You warrant that you hold all rights to the content you upload or enter (text, images, logos, graphic elements), that it does not infringe third-party rights (in particular copyright, trademark or personality rights) and that it does not breach applicable law. You are responsible for the content you supply. We reserve the right to refuse orders with unlawful, offensive or infringing content; in that case any payment already made will be refunded.

You grant us the right to use your design solely for the fulfilment of your order.

Article 7 — Production, approval and delivery

Runs under 1,000 units are usually produced and made ready for dispatch within one or two working days; for larger quantities we confirm the timeline separately. For orders over 100 units we send you, before the full run is produced, a real photo of a printed wrapper for approval. Dispatch is from the United Kingdom; delivery time depends on the destination country and customs handling.

Article 8 — Right of withdrawal

Under Article 16(c) of Directive 2011/83/EU on consumer rights (as implemented in your country of residence), the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Since all products ordered through the online designer are printed individually for you, withdrawal after completing the order is excluded. In addition, under Article 16(e) of the same Directive, the right of withdrawal also does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery. Article 9 — Warranty and defects

You have the statutory conformity rights for consumer sales under Directive (EU) 2019/771 as implemented in your country of residence. If the delivered goods are defective, differ from the approved sample, are misprinted through our fault or arrive damaged in transit, contact us within a reasonable time at , quoting your order number and, where possible, with photos. In that case we redeliver free of charge or refund the purchase price. Your statutory rights are not limited.

Minor colour or position deviations from the on-screen preview caused by the printing process do not constitute a defect.

Article 10 — Liability

We are liable without limitation for intent or gross negligence, and for injury to life, body or health. In cases of slight negligence we are liable only for the breach of a material contractual obligation, and limited to the foreseeable damage typical for this type of contract. Mandatory statutory liability provisions remain unaffected.

Article 11 — Product information

Condoms are Class IIb medical devices. Read the enclosed instructions before use. Personalisation applies only to the wrapper, never to the condom.

Article 12 — Dispute resolution and applicable law

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We ask you to write to us directly first, so we can look for a solution together.

Mandatory consumer-protection provisions of the law of your habitual residence apply; in all other respects English law applies. The mandatory consumer-protection provisions of your country of residence remain unaffected.

Article 13 — Final provisions

If any provision of these terms is invalid, the validity of the remaining provisions is not affected.
